Worthing roofer fined £600 for fly-tipping

Peter Shallis, 48, of Pines Avenue, was fined 600 and ordered to complete 250 hours of community service after appearing at Worthing Magistrates' Court.

Shallis, trading as Sussex Roofing Restorations, pleaded not guilty to the fly-tipping charge and other waste-related offences, but was convicted by magistrates last Friday, February 19.

The court heard Shallis had dumped material taken from a roof being replaced in West Avenue into the garden of a derelict house further along the road, on May 30, 2008.

The developer who owned the property was later required by the council to remove the material at considerable expense.

For this offence, Shallis was ordered to complete 125 hours of unpaid work in the community.

Dumped timber

He was sentenced to a further 125 hours of unpaid work for an offence in Woods Way, where timber and other materials were dumped on the pavement on January 31, 2009.

Shallis claimed his vehicle had been borrowed by an associate, but was convicted on the basis that he controlled the vehicle from which the fly-tipping took place.

He was also found guilty of carrying waste without a valid licence and failing to account for the disposal or transfer of any of his waste in a two-year period.

Shallis contended he was unaware that he needed a waste carriers' licence to carry waste generated by his business, or that he needed to keep records of his waste disposal transactions.

The magistrates fined him a total of 600 and warned him he had to ensure his waste was disposed of responsibly in future.

Following the case, Clive Roberts, Worthing Borough Council's cabinet member for clean and green environment, said: "Mr Shallis gained financially by not disposing of his waste correctly, giving him an unfair business advantage over competitors who responsibly manage their waste."
